{"id":1188,"date":"2026-03-26T11:03:00","date_gmt":"2026-03-26T11:03:00","guid":{"rendered":"https:\/\/voiceguard-project.eu\/?p=1188"},"modified":"2026-05-04T13:33:32","modified_gmt":"2026-05-04T13:33:32","slug":"novedades-de-la-directiva-sobre-los-denunciantes-y-tendencias-cambiantes-en-materia-de-aplicacion-que-conviene-seguir-de","status":"publish","type":"post","link":"https:\/\/voiceguard-project.eu\/es\/2026\/03\/26\/novedades-de-la-directiva-sobre-los-denunciantes-y-tendencias-cambiantes-en-materia-de-aplicacion-que-conviene-seguir-de\/","title":{"rendered":"Novedades\u00a0de la\u00a0Directiva\u00a0sobre\u00a0los\u00a0denunciantes\u00a0y\u00a0tendencias\u00a0cambiantes\u00a0en\u00a0materia\u00a0de\u00a0aplicaci\u00f3n\u00a0que\u00a0conviene\u00a0seguir\u00a0de\u00a0cerca\u00a0en\u00a02025-2026\u00a0"},"content":{"rendered":"\n<p>Con la&nbsp;aprobaci\u00f3n&nbsp;de la&nbsp;Directiva&nbsp;(UE) 2019\/1937 (\u00abDirectiva&nbsp;sobre&nbsp;los&nbsp;denunciantes\u00bb) y&nbsp;su&nbsp;transposici\u00f3n&nbsp;a las&nbsp;legislaciones&nbsp;nacionales&nbsp;de&nbsp;los&nbsp;Estados&nbsp;miembros&nbsp;(\u00abEM\u00bb) de&nbsp;toda&nbsp;la UE (\u00abDirectiva&nbsp;de la UE&nbsp;sobre&nbsp;los&nbsp;denunciantes\u00bb), la UE ha&nbsp;hecho&nbsp;realidad&nbsp;una&nbsp;armonizaci\u00f3n&nbsp;exhaustiva&nbsp;de las&nbsp;protecciones&nbsp;m\u00ednimas&nbsp;para&nbsp;los&nbsp;denunciantes.&nbsp;<\/p>\n\n\n\n<p>De&nbsp;cara&nbsp;a 2025 y&nbsp;m\u00e1s&nbsp;all\u00e1, se&nbsp;avecinan&nbsp;varias&nbsp;ampliaciones&nbsp;legislativas,&nbsp;evaluaciones&nbsp;y&nbsp;transposiciones&nbsp;que&nbsp;afectar\u00e1n&nbsp;no solo al&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;material de la&nbsp;Directiva,&nbsp;sino&nbsp;tambi\u00e9n a la&nbsp;evoluci\u00f3n&nbsp;de las&nbsp;mejores&nbsp;pr\u00e1cticas&nbsp;en&nbsp;materia&nbsp;de&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes&nbsp;en&nbsp;general.&nbsp;<\/p>\n\n\n\n<p><strong>Evaluaci\u00f3n&nbsp;de la&nbsp;Directiva&nbsp;de la UE&nbsp;sobre&nbsp;los&nbsp;denunciantes&nbsp;de 2025 y&nbsp;posible&nbsp;ampliaci\u00f3n&nbsp;de&nbsp;su&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n<\/strong>&nbsp;<\/p>\n\n\n\n<p>A&nbsp;m\u00e1s&nbsp;tardar&nbsp;<strong>el&nbsp;17 de&nbsp;diciembre&nbsp;de 2025<\/strong>, la Comisi\u00f3n&nbsp;deber\u00e1&nbsp;presentar&nbsp;al&nbsp;Parlamento&nbsp;Europeo y al Consejo un&nbsp;informe&nbsp;en&nbsp;el&nbsp;que&nbsp;se&nbsp;eval\u00fae:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0eficacia\u00a0de las\u00a0leyes\u00a0promulgadas\u00a0por\u00a0los\u00a0Estados\u00a0miembros\u00a0para\u00a0transponer\u00a0la\u00a0Directiva; y\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0eficacia\u00a0del\u00a0marco\u00a0de\u00a0protecci\u00f3n\u00a0de\u00a0los\u00a0denunciantes\u00a0en\u00a0la UE.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>En&nbsp;concreto,&nbsp;en&nbsp;virtud&nbsp;<strong>del&nbsp;art\u00edculo&nbsp;27,&nbsp;apartado&nbsp;3, de la&nbsp;Directiva&nbsp;sobre&nbsp;los&nbsp;denunciantes<\/strong>:&nbsp;<\/p>\n\n\n\n<p>[La Comisi\u00f3n]&nbsp;presentar\u00e1&nbsp;al&nbsp;Parlamento&nbsp;Europeo y al Consejo, a&nbsp;m\u00e1s&nbsp;tardar&nbsp;el&nbsp;17 de&nbsp;diciembre&nbsp;de 2025, un&nbsp;informe&nbsp;sobre&nbsp;la&nbsp;transposici\u00f3n&nbsp;y la&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;presente&nbsp;Directiva.&nbsp;Dicho&nbsp;informe&nbsp;deber\u00e1,&nbsp;en&nbsp;particular:&nbsp;<\/p>\n\n\n\n<p>(a)&nbsp;evaluar&nbsp;la&nbsp;eficacia&nbsp;de las&nbsp;medidas&nbsp;adoptadas&nbsp;por&nbsp;cada&nbsp;Estado&nbsp;miembro&nbsp;para&nbsp;transponer&nbsp;la&nbsp;presente&nbsp;Directiva&nbsp;y&nbsp;su&nbsp;impacto&nbsp;en&nbsp;el&nbsp;funcionamiento&nbsp;del&nbsp;marco&nbsp;de&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes&nbsp;establecido&nbsp;de&nbsp;conformidad&nbsp;con la&nbsp;presente&nbsp;Directiva; y&nbsp;<\/p>\n\n\n\n<p>(b)&nbsp;evaluar&nbsp;si&nbsp;se&nbsp;requieren&nbsp;medidas&nbsp;adicionales,&nbsp;<strong>incluida&nbsp;la&nbsp;ampliaci\u00f3n&nbsp;del&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;presente&nbsp;Directiva&nbsp;para&nbsp;abarcar&nbsp;otros&nbsp;actos&nbsp;de la Uni\u00f3n o&nbsp;\u00e1mbitos&nbsp;pol\u00edticos<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Entre&nbsp;los&nbsp;posibles&nbsp;\u00e1mbitos&nbsp;de&nbsp;ampliaci\u00f3n&nbsp;mencionados&nbsp;por&nbsp;la Comisi\u00f3n&nbsp;figuran:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0seguridad\u00a0y\u00a0la\u00a0salud\u00a0en\u00a0el\u00a0trabajo; y\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>las\u00a0condiciones\u00a0de\u00a0trabajo.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Las&nbsp;federaciones&nbsp;empresariales&nbsp;han&nbsp;se\u00f1alado&nbsp;que&nbsp;probablemente&nbsp;presionar\u00e1n&nbsp;para&nbsp;que&nbsp;se&nbsp;introduzcan&nbsp;cambios&nbsp;en&nbsp;el&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;protecci\u00f3n&nbsp;durante&nbsp;esta&nbsp;primera&nbsp;revisi\u00f3n. Un&nbsp;cambio&nbsp;sugerido&nbsp;ser\u00eda&nbsp;<strong>aumentar&nbsp;el&nbsp;n\u00famero&nbsp;m\u00ednimo&nbsp;de&nbsp;empleados&nbsp;para&nbsp;los&nbsp;canales de&nbsp;denuncia&nbsp;internos&nbsp;de 50 a 100&nbsp;empleados&nbsp;o&nbsp;m\u00e1s.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Dicho&nbsp;cambio&nbsp;tendr\u00eda&nbsp;por&nbsp;objeto&nbsp;reducir&nbsp;la carga&nbsp;administrativa&nbsp;que&nbsp;recae&nbsp;sobre&nbsp;las&nbsp;pymes.&nbsp;<\/p>\n\n\n\n<p><strong>2026 \u2013&nbsp;Ampliaci\u00f3n&nbsp;de las&nbsp;protecciones&nbsp;de la UE para&nbsp;los&nbsp;denunciantes&nbsp;con&nbsp;el&nbsp;fin de&nbsp;incluir&nbsp;la Ley de IA de la UE<\/strong>&nbsp;<\/p>\n\n\n\n<p>A&nbsp;partir&nbsp;del<strong>&nbsp;2 de&nbsp;agosto&nbsp;de 2026<\/strong>, la&nbsp;Directiva&nbsp;sobre&nbsp;denuncia&nbsp;de&nbsp;irregularidades&nbsp;se&nbsp;aplicar\u00e1&nbsp;a la&nbsp;notificaci\u00f3n&nbsp;de&nbsp;infracciones&nbsp;de la&nbsp;<strong>Ley de IA de la UE<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>\u00bfQu\u00e9&nbsp;significa&nbsp;esto?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Si&nbsp;trabaja&nbsp;para un&nbsp;proveedor&nbsp;de&nbsp;<strong>IA de&nbsp;uso&nbsp;general (\u00abGPAI\u00bb)<\/strong>,&nbsp;estar\u00e1&nbsp;protegido&nbsp;si&nbsp;denuncia&nbsp;que&nbsp;el&nbsp;producto&nbsp;de&nbsp;dicho&nbsp;proveedor&nbsp;\u2014del&nbsp;que&nbsp;se le ha&nbsp;informado&nbsp;que&nbsp;es&nbsp;<strong>\u00abIA de&nbsp;riesgo&nbsp;sist\u00e9mico\u00bb&nbsp;seg\u00fan&nbsp;el&nbsp;art\u00edculo&nbsp;2,&nbsp;apartado&nbsp;11, de la Ley de&nbsp;<\/strong>IA\u2014 no&nbsp;cuenta&nbsp;con las&nbsp;medidas&nbsp;de&nbsp;ciberseguridad&nbsp;adecuadas, lo&nbsp;que&nbsp;supone&nbsp;una&nbsp;infracci\u00f3n&nbsp;del&nbsp;<strong>art\u00edculo&nbsp;55 de la Ley de IA<\/strong>.&nbsp;<\/p>\n\n\n\n<p>No&nbsp;todos&nbsp;los&nbsp;riesgos&nbsp;generados&nbsp;por&nbsp;la IA&nbsp;quedan&nbsp;actualmente&nbsp;recogidos&nbsp;en&nbsp;los&nbsp;ejemplos&nbsp;anteriores,&nbsp;pero&nbsp;este&nbsp;cambio&nbsp;<strong>ampliar\u00e1&nbsp;sustancialmente&nbsp;el&nbsp;alcance&nbsp;de las&nbsp;protecciones&nbsp;a&nbsp;los&nbsp;denunciantes,&nbsp;ya&nbsp;que&nbsp;se&nbsp;aplicar\u00e1n&nbsp;a&nbsp;muchos&nbsp;tipos&nbsp;de&nbsp;riesgos&nbsp;relacionados&nbsp;con la IA.<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>2026 y&nbsp;a\u00f1os&nbsp;posteriores:&nbsp;ampliaci\u00f3n&nbsp;del&nbsp;alcance&nbsp;mediante&nbsp;la CSDDD<\/strong>&nbsp;<\/p>\n\n\n\n<p>El&nbsp;alcance&nbsp;de la&nbsp;Directiva&nbsp;sobre&nbsp;denuncia&nbsp;de&nbsp;irregularidades&nbsp;tambi\u00e9n se&nbsp;ampliar\u00e1&nbsp;mediante&nbsp;la&nbsp;<strong>Directiva&nbsp;sobre&nbsp;la diligencia&nbsp;debida&nbsp;en&nbsp;materia&nbsp;de&nbsp;sostenibilidad&nbsp;empresarial&nbsp;(CSDDD)<\/strong>,&nbsp;que&nbsp;entr\u00f3&nbsp;en&nbsp;vigor&nbsp;el<strong>&nbsp;25 de&nbsp;julio&nbsp;de 2024<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Esta&nbsp;Directiva&nbsp;modifica&nbsp;la&nbsp;Directiva&nbsp;sobre&nbsp;Denuncias&nbsp;de Irregularidades de modo&nbsp;que&nbsp;tambi\u00e9n se&nbsp;conceda&nbsp;protecci\u00f3n&nbsp;a&nbsp;quienes&nbsp;denuncien&nbsp;incumplimientos&nbsp;de la&nbsp;legislaci\u00f3n&nbsp;nacional&nbsp;que&nbsp;aplique&nbsp;los&nbsp;requisitos&nbsp;de la UE&nbsp;en&nbsp;materia&nbsp;de diligencia&nbsp;debida&nbsp;en&nbsp;materia&nbsp;de&nbsp;sostenibilidad.&nbsp;<\/p>\n\n\n\n<p>En&nbsp;otras&nbsp;palabras,&nbsp;los&nbsp;denunciantes&nbsp;que&nbsp;informen&nbsp;de&nbsp;infracciones&nbsp;de la&nbsp;legislaci\u00f3n&nbsp;nacional&nbsp;relacionadas&nbsp;con:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>los\u00a0derechos\u00a0laborales\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0diligencia\u00a0debida\u00a0en\u00a0materia\u00a0de\u00a0derechos\u00a0humanos\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>da\u00f1os\u00a0medioambientales\u00a0<\/li>\n<\/ul>\n\n\n\n<p>podr\u00e1n&nbsp;acogerse&nbsp;a&nbsp;<strong>las&nbsp;protecciones&nbsp;de la&nbsp;Directiva&nbsp;de la UE&nbsp;sobre&nbsp;denunciantes&nbsp;<\/strong>una&nbsp;vez&nbsp;que&nbsp;los&nbsp;Estados&nbsp;miembros&nbsp;hayan&nbsp;transpuesto&nbsp;la CSDDD a&nbsp;su&nbsp;legislaci\u00f3n&nbsp;nacional.&nbsp;<\/p>\n\n\n\n<p>En conjunto,&nbsp;los&nbsp;empleados&nbsp;podr\u00e1n&nbsp;estar&nbsp;protegidos&nbsp;al&nbsp;denunciar&nbsp;actividades&nbsp;que&nbsp;perjudiquen:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>el\u00a0medio\u00a0ambiente;\u00a0o\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>las\u00a0normas\u00a0laborales\u00a0reconocidas,\u00a0como\u00a0las\u00a0establecidas\u00a0en\u00a0<strong>los\u00a0convenios\u00a0de la Organizaci\u00f3n\u00a0Internacional\u00a0del\u00a0Trabajo\u00a0(\u00abOIT\u00bb)<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>La UE se centra&nbsp;en&nbsp;mejorar&nbsp;la&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;Directiva&nbsp;sobre&nbsp;los&nbsp;denunciantes<\/strong>&nbsp;<\/p>\n\n\n\n<p>Adem\u00e1s&nbsp;de&nbsp;evaluar&nbsp;posibles&nbsp;ampliaciones&nbsp;del&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;Directiva&nbsp;de la UE&nbsp;sobre&nbsp;los&nbsp;denunciantes, la UE&nbsp;examinar\u00e1&nbsp;cada&nbsp;vez&nbsp;m\u00e1s&nbsp;de&nbsp;cerca&nbsp;las&nbsp;implementaciones&nbsp;existentes&nbsp;por&nbsp;parte&nbsp;de&nbsp;los&nbsp;Estados&nbsp;miembros.&nbsp;<\/p>\n\n\n\n<p>En&nbsp;<strong>julio&nbsp;de 2024<\/strong>, la Comisi\u00f3n&nbsp;public\u00f3&nbsp;un&nbsp;informe&nbsp;sobre&nbsp;la&nbsp;aplicaci\u00f3n&nbsp;y&nbsp;transposici\u00f3n&nbsp;de la&nbsp;Directiva. El&nbsp;informe&nbsp;detect\u00f3&nbsp;varias&nbsp;deficiencias, entre&nbsp;ellas:&nbsp;<\/p>\n\n\n\n<p><strong>Cuesti\u00f3n&nbsp;1:&nbsp;\u00c1mbito&nbsp;de&nbsp;protecci\u00f3n<\/strong>&nbsp;<\/p>\n\n\n\n<p>La&nbsp;falta&nbsp;de&nbsp;protecci\u00f3n&nbsp;adecuada&nbsp;de las&nbsp;denuncias&nbsp;presentadas&nbsp;sobre&nbsp;la base de&nbsp;sospechas&nbsp;razonables&nbsp;o de&nbsp;los&nbsp;intentos&nbsp;de&nbsp;encubrimiento&nbsp;de&nbsp;infracciones.&nbsp;<\/p>\n\n\n\n<p><strong>Cuesti\u00f3n&nbsp;2:&nbsp;Sanciones<\/strong>&nbsp;<\/p>\n\n\n\n<p>Nueve&nbsp;Estados&nbsp;miembros&nbsp;no&nbsp;establecieron&nbsp;claramente&nbsp;que&nbsp;se&nbsp;aplicaran&nbsp;sanciones&nbsp;en&nbsp;caso&nbsp;de&nbsp;represalias&nbsp;contra&nbsp;los&nbsp;denunciantes,&nbsp;obstrucci\u00f3n&nbsp;de&nbsp;los&nbsp;canales de&nbsp;denuncia&nbsp;o&nbsp;incumplimiento&nbsp;de la&nbsp;confidencialidad&nbsp;de la&nbsp;identidad&nbsp;del&nbsp;denunciante.&nbsp;<\/p>\n\n\n\n<p><strong>Cuesti\u00f3n&nbsp;3:&nbsp;Exenciones&nbsp;de&nbsp;responsabilidad<\/strong>&nbsp;<\/p>\n\n\n\n<p>Algunos&nbsp;Estados&nbsp;miembros&nbsp;no&nbsp;transpusieron&nbsp;adecuadamente&nbsp;los&nbsp;requisitos&nbsp;de la&nbsp;Directiva&nbsp;que&nbsp;aclaran&nbsp;cu\u00e1ndo&nbsp;no se&nbsp;puede&nbsp;considerar&nbsp;responsables&nbsp;a las personas&nbsp;que&nbsp;denuncian&nbsp;por&nbsp;la&nbsp;divulgaci\u00f3n&nbsp;de&nbsp;informaci\u00f3n&nbsp;si&nbsp;dicha&nbsp;divulgaci\u00f3n&nbsp;se&nbsp;realiz\u00f3&nbsp;para&nbsp;revelar&nbsp;una&nbsp;infracci\u00f3n.&nbsp;<\/p>\n\n\n\n<p>La Comisi\u00f3n&nbsp;se\u00f1al\u00f3&nbsp;que&nbsp;estos&nbsp;aspectos&nbsp;constitu\u00edan&nbsp;las&nbsp;<strong>\u00abprincipales&nbsp;deficiencias\u00bb&nbsp;<\/strong>en&nbsp;la&nbsp;aplicaci\u00f3n&nbsp;de la&nbsp;Directiva.&nbsp;<\/p>\n\n\n\n<p>Poco&nbsp;despu\u00e9s, a&nbsp;<strong>principios&nbsp;de 2025<\/strong>, la Comisi\u00f3n&nbsp;cumpli\u00f3&nbsp;su&nbsp;amenaza&nbsp;de&nbsp;intensificar&nbsp;las&nbsp;medidas&nbsp;de&nbsp;ejecuci\u00f3n&nbsp;al&nbsp;imponer&nbsp;a&nbsp;los&nbsp;Estados&nbsp;miembros&nbsp;una&nbsp;multa&nbsp;conjunta&nbsp;<strong>de 38&nbsp;millones&nbsp;de euros&nbsp;<\/strong>por&nbsp;no&nbsp;haber&nbsp;cumplido&nbsp;el&nbsp;<strong>plazo&nbsp;del 17 de&nbsp;julio&nbsp;de 2024&nbsp;<\/strong>para&nbsp;transponer&nbsp;la&nbsp;Directiva.&nbsp;<\/p>\n\n\n\n<p>Esperamos&nbsp;que&nbsp;esta&nbsp;tendencia&nbsp;contin\u00fae,&nbsp;ya&nbsp;que&nbsp;la Comisi\u00f3n&nbsp;ampl\u00eda&nbsp;su&nbsp;escrutinio&nbsp;m\u00e1s&nbsp;all\u00e1&nbsp;de&nbsp;los&nbsp;plazos&nbsp;de&nbsp;transposici\u00f3n&nbsp;incumplidos&nbsp;para&nbsp;abarcar&nbsp;la&nbsp;<strong>calidad&nbsp;de las&nbsp;implementaciones&nbsp;de&nbsp;los&nbsp;Estados&nbsp;miembros<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>Cambio&nbsp;hacia&nbsp;la&nbsp;prevenci\u00f3n&nbsp;en&nbsp;las&nbsp;normas&nbsp;de&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes<\/strong>&nbsp;<\/p>\n\n\n\n<p>M\u00e1s&nbsp;all\u00e1&nbsp;de las&nbsp;ampliaciones&nbsp;del&nbsp;\u00e1mbito&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;material de la&nbsp;Directiva&nbsp;de la UE&nbsp;sobre&nbsp;los&nbsp;denunciantes, la norma&nbsp;relativa&nbsp;a la&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes&nbsp;en&nbsp;Europa&nbsp;est\u00e1&nbsp;evolucionando.&nbsp;<\/p>\n\n\n\n<p>Tradicionalmente,&nbsp;los&nbsp;denunciantes&nbsp;recib\u00edan&nbsp;protecci\u00f3n&nbsp;<strong>a posteriori&nbsp;<\/strong>mediante&nbsp;demandas&nbsp;en&nbsp;las&nbsp;que&nbsp;reclamaban&nbsp;indemnizaciones&nbsp;econ\u00f3micas&nbsp;a&nbsp;los&nbsp;empleadores.&nbsp;<\/p>\n\n\n\n<p>A menudo,&nbsp;el&nbsp;denunciante&nbsp;ten\u00eda&nbsp;que&nbsp;soportar&nbsp;represalias&nbsp;antes
