Las personas&nbsp;que&nbsp;denuncian&nbsp;infracciones&nbsp;como&nbsp;la&nbsp;corrupci\u00f3n,&nbsp;el&nbsp;fraude&nbsp;o&nbsp;el&nbsp;abuso&nbsp;de&nbsp;poder&nbsp;contribuyen&nbsp;directamente&nbsp;al&nbsp;cumplimiento&nbsp;de las&nbsp;normas&nbsp;jur\u00eddicas&nbsp;al&nbsp;sacar&nbsp;a la luz&nbsp;violaciones&nbsp;que, de&nbsp;otro&nbsp;modo,&nbsp;podr\u00edan&nbsp;pasar&nbsp;desapercibidas. Por&nbsp;consiguiente,&nbsp;su&nbsp;protecci\u00f3n&nbsp;no es&nbsp;meramente&nbsp;una&nbsp;opci\u00f3n&nbsp;pol\u00edtica,&nbsp;sino&nbsp;una&nbsp;necesidad&nbsp;jur\u00eddica&nbsp;para&nbsp;el&nbsp;funcionamiento&nbsp;eficaz&nbsp;de&nbsp;los&nbsp;mecanismos&nbsp;anticorrupci\u00f3n.&nbsp;<\/p>\n\n\n\n<p>Este&nbsp;reconocimiento&nbsp;sustenta&nbsp;la&nbsp;adopci\u00f3n&nbsp;de la&nbsp;Directiva&nbsp;(UE) 2019\/1937&nbsp;sobre&nbsp;la&nbsp;protecci\u00f3n&nbsp;de las personas&nbsp;que&nbsp;denuncian&nbsp;infracciones&nbsp;del&nbsp;Derecho&nbsp;de la Uni\u00f3n. La&nbsp;Directiva&nbsp;establece&nbsp;normas&nbsp;m\u00ednimas&nbsp;en&nbsp;todos&nbsp;los&nbsp;Estados&nbsp;miembros,&nbsp;incluidas&nbsp;las&nbsp;obligaciones&nbsp;de&nbsp;crear&nbsp;canales de&nbsp;denuncia&nbsp;seguros,&nbsp;garantizar&nbsp;la&nbsp;confidencialidad&nbsp;y&nbsp;proporcionar&nbsp;protecci\u00f3n&nbsp;contra las&nbsp;represalias. Su&nbsp;objetivo&nbsp;es&nbsp;facilitar&nbsp;la&nbsp;denuncia&nbsp;de&nbsp;conductas&nbsp;il\u00edcitas&nbsp;y, de ese modo,&nbsp;mejorar&nbsp;el&nbsp;cumplimiento&nbsp;del&nbsp;Derecho&nbsp;de la UE.&nbsp;<\/p>\n\n\n\n<p>Sin embargo, la&nbsp;evoluci\u00f3n&nbsp;desde&nbsp;la entrada&nbsp;en&nbsp;vigor&nbsp;de la&nbsp;Directiva&nbsp;indica&nbsp;que&nbsp;la&nbsp;mera&nbsp;existencia&nbsp;de un&nbsp;marco&nbsp;jur\u00eddico&nbsp;no&nbsp;garantiza&nbsp;una&nbsp;aplicaci\u00f3n&nbsp;efectiva.&nbsp;<\/p>\n\n\n\n<p><strong>El&nbsp;\u00cdndice&nbsp;de&nbsp;Percepci\u00f3n&nbsp;de la&nbsp;Corrupci\u00f3n&nbsp;como&nbsp;indicador&nbsp;de la&nbsp;eficacia&nbsp;jur\u00eddica<\/strong>&nbsp;<\/p>\n\n\n\n<p>El&nbsp;<a href=\"https:\/\/www.transparency.org\/en\/cpi\/2025\" target=\"_blank\" rel=\"noreferrer noopener\">\u00cdndice de Percepci\u00f3n de la Corrupci\u00f3n<\/a>&nbsp;(IPC),&nbsp;elaborado&nbsp;por&nbsp;Transparency International,&nbsp;sirve&nbsp;como&nbsp;referencia&nbsp;ampliamente&nbsp;reconocida&nbsp;para&nbsp;evaluar&nbsp;los&nbsp;niveles&nbsp;percibidos&nbsp;de&nbsp;corrupci\u00f3n&nbsp;en&nbsp;el&nbsp;sector&nbsp;p\u00fablico.&nbsp;Aunque&nbsp;no es&nbsp;una&nbsp;medida&nbsp;directa&nbsp;del&nbsp;cumplimiento&nbsp;de la ley,&nbsp;constituye&nbsp;un&nbsp;indicador&nbsp;importante&nbsp;de la&nbsp;eficacia&nbsp;de&nbsp;los&nbsp;marcos&nbsp;anticorrupci\u00f3n&nbsp;en&nbsp;la&nbsp;pr\u00e1ctica.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Entre 2019 y 2025,&nbsp;los&nbsp;datos&nbsp;del IPC&nbsp;revelan&nbsp;una&nbsp;tendencia&nbsp;de&nbsp;estancamiento&nbsp;generalizado&nbsp;en&nbsp;toda&nbsp;la Uni\u00f3n Europea, lo&nbsp;que&nbsp;sugiere&nbsp;un&nbsp;avance&nbsp;limitado&nbsp;en&nbsp;la&nbsp;reducci\u00f3n&nbsp;de la&nbsp;corrupci\u00f3n&nbsp;a&nbsp;pesar&nbsp;de la&nbsp;introducci\u00f3n&nbsp;de&nbsp;nuevos&nbsp;instrumentos&nbsp;jur\u00eddicos,&nbsp;incluida&nbsp;la&nbsp;Directiva&nbsp;(UE) 2019\/1937.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.liberties.eu\/f\/vdxw3e\" target=\"_blank\" rel=\"noreferrer noopener\">El Informe sobre el Estado de Derecho de Liberties 2025<\/a>&nbsp;identifica&nbsp;varios&nbsp;problemas&nbsp;comunes&nbsp;en&nbsp;Bulgaria, la Rep\u00fablica Checa, Grecia,&nbsp;Ruman\u00eda&nbsp;y Espa\u00f1a&nbsp;que&nbsp;afectan&nbsp;a&nbsp;los&nbsp;esfuerzos&nbsp;anticorrupci\u00f3n&nbsp;y a la&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes.&nbsp;<\/p>\n\n\n\n<p>En primer&nbsp;lugar,&nbsp;muchos&nbsp;de&nbsp;estos&nbsp;pa\u00edses&nbsp;muestran&nbsp;un&nbsp;estancamiento&nbsp;en&nbsp;las&nbsp;reformas, lo&nbsp;que&nbsp;significa&nbsp;que&nbsp;se&nbsp;adoptan&nbsp;cambios&nbsp;legales,&nbsp;pero&nbsp;estos&nbsp;no se&nbsp;traducen&nbsp;en&nbsp;mejoras&nbsp;reales&nbsp;en&nbsp;la&nbsp;pr\u00e1ctica.&nbsp;<\/p>\n\n\n\n<p>La&nbsp;aplicaci\u00f3n&nbsp;de las&nbsp;medidas&nbsp;anticorrupci\u00f3n&nbsp;sigue&nbsp;siendo&nbsp;d\u00e9bil. Las&nbsp;investigaciones&nbsp;suelen&nbsp;ser&nbsp;lentas, las&nbsp;sanciones&nbsp;son&nbsp;inconsistentes&nbsp;y&nbsp;los&nbsp;organismos&nbsp;de&nbsp;supervisi\u00f3n&nbsp;pueden&nbsp;carecer&nbsp;de&nbsp;independencia&nbsp;o de&nbsp;recursos&nbsp;suficientes.&nbsp;<\/p>\n\n\n\n<p>Persisten&nbsp;las&nbsp;preocupaciones&nbsp;sobre&nbsp;la&nbsp;independencia&nbsp;judicial,&nbsp;incluidas&nbsp;las&nbsp;presiones&nbsp;pol\u00edticas&nbsp;y las&nbsp;debilidades&nbsp;estructurales&nbsp;que&nbsp;socavan&nbsp;la confianza&nbsp;en&nbsp;el&nbsp;sistema&nbsp;judicial.&nbsp;<\/p>\n\n\n\n<p>Otra&nbsp;cuesti\u00f3n&nbsp;clave es la&nbsp;limitada&nbsp;aplicaci\u00f3n&nbsp;de las&nbsp;recomendaciones&nbsp;de la UE,&nbsp;ya&nbsp;que&nbsp;muchas&nbsp;reformas&nbsp;se&nbsp;retrasan, se&nbsp;repiten&nbsp;o solo se&nbsp;llevan&nbsp;a&nbsp;cabo&nbsp;parcialmente.&nbsp;<\/p>\n\n\n\n<p>Por&nbsp;\u00faltimo,&nbsp;persiste&nbsp;una&nbsp;brecha&nbsp;entre la ley y la&nbsp;pr\u00e1ctica. Si bien&nbsp;existen&nbsp;marcos&nbsp;jur\u00eddicos&nbsp;que&nbsp;incluyen&nbsp;protecciones&nbsp;para&nbsp;los&nbsp;denunciantes, a menudo no son&nbsp;plenamente&nbsp;eficaces&nbsp;en&nbsp;la&nbsp;realidad. Esto se&nbsp;ve&nbsp;reforzado&nbsp;por&nbsp;la&nbsp;escasa&nbsp;confianza de la&nbsp;ciudadan\u00eda&nbsp;y&nbsp;por&nbsp;entornos&nbsp;que&nbsp;pueden&nbsp;desalentar&nbsp;la&nbsp;denuncia&nbsp;de&nbsp;irregularidades.&nbsp;<\/p>\n\n\n\n<p>Estos&nbsp;retos&nbsp;ponen&nbsp;de relieve&nbsp;un&nbsp;problema: sin&nbsp;una&nbsp;aplicaci\u00f3n&nbsp;efectiva&nbsp;y&nbsp;unas&nbsp;instituciones&nbsp;s\u00f3lidas,&nbsp;las&nbsp;protecciones&nbsp;legales&nbsp;por&nbsp;s\u00ed&nbsp;solas&nbsp;no&nbsp;bastan&nbsp;para&nbsp;reducir&nbsp;la&nbsp;corrupci\u00f3n&nbsp;ni&nbsp;para&nbsp;garantizar&nbsp;que&nbsp;los&nbsp;denunciantes&nbsp;est\u00e9n&nbsp;verdaderamente&nbsp;protegidos.&nbsp;<\/p>\n\n\n\n<p>Desde&nbsp;una&nbsp;perspectiva&nbsp;jur\u00eddica,&nbsp;esto&nbsp;suscita&nbsp;inquietudes&nbsp;respecto&nbsp;a la&nbsp;eficacia&nbsp;pr\u00e1ctica&nbsp;(effet&nbsp;utile) de la&nbsp;Directiva&nbsp;y al&nbsp;grado&nbsp;en&nbsp;que&nbsp;sus&nbsp;objetivos&nbsp;se&nbsp;est\u00e1n&nbsp;alcanzando&nbsp;a&nbsp;nivel&nbsp;nacional.&nbsp;<\/p>\n\n\n\n<p><strong>Panorama&nbsp;comparativo&nbsp;de la&nbsp;evoluci\u00f3n&nbsp;del IPC (2019-2025)<\/strong>&nbsp;<\/p>\n\n\n\n<p>Un&nbsp;an\u00e1lisis&nbsp;de las&nbsp;puntuaciones&nbsp;del IPC&nbsp;en&nbsp;los&nbsp;Estados&nbsp;miembros&nbsp;que&nbsp;participan&nbsp;en&nbsp;el&nbsp;proyecto&nbsp;Voice Guard&nbsp;\u2014Bulgaria, la Rep\u00fablica Checa,&nbsp;Ruman\u00eda, Grecia, Espa\u00f1a y&nbsp;Luxemburgo\u2014&nbsp;ilustra&nbsp;resultados&nbsp;divergentes&nbsp;en&nbsp;la&nbsp;aplicaci\u00f3n&nbsp;de las&nbsp;medidas&nbsp;anticorrupci\u00f3n.&nbsp;<\/p>\n\n\n\n<p>El IPC&nbsp;clasifica&nbsp;a 182&nbsp;pa\u00edses&nbsp;y&nbsp;territorios&nbsp;de&nbsp;todo&nbsp;el&nbsp;mundo&nbsp;seg\u00fan&nbsp;sus&nbsp;niveles&nbsp;percibidos&nbsp;de&nbsp;corrupci\u00f3n&nbsp;en&nbsp;el&nbsp;sector&nbsp;p\u00fablico. Esto&nbsp;socava&nbsp;el&nbsp;objetivo&nbsp;de la&nbsp;Directiva&nbsp;de&nbsp;garantizar&nbsp;una&nbsp;protecci\u00f3n&nbsp;real y&nbsp;efectiva&nbsp;contra las&nbsp;represalias.&nbsp;<\/p>\n\n\n\n<p>3.&nbsp;Limitaciones&nbsp;institucionales&nbsp;<\/p>\n\n\n\n<p>Las&nbsp;autoridades&nbsp;competentes&nbsp;encargadas&nbsp;de&nbsp;recibir&nbsp;e&nbsp;investigar&nbsp;las&nbsp;denuncias&nbsp;suelen&nbsp;carecer&nbsp;de la&nbsp;independencia,&nbsp;los&nbsp;conocimientos&nbsp;especializados&nbsp;o&nbsp;los&nbsp;recursos&nbsp;suficientes, lo&nbsp;que&nbsp;afecta&nbsp;a&nbsp;su&nbsp;capacidad&nbsp;para&nbsp;garantizar&nbsp;un&nbsp;seguimiento&nbsp;adecuado.&nbsp;<\/p>\n\n\n\n<p>4.&nbsp;Incertidumbre&nbsp;jur\u00eddica&nbsp;y&nbsp;fragmentaci\u00f3n&nbsp;<\/p>\n\n\n\n<p>Las&nbsp;divergencias&nbsp;en&nbsp;las&nbsp;medidas&nbsp;nacionales&nbsp;de&nbsp;transposici\u00f3n&nbsp;han&nbsp;dado&nbsp;lugar&nbsp;a&nbsp;incoherencias&nbsp;en&nbsp;el&nbsp;alcance&nbsp;y&nbsp;el&nbsp;nivel&nbsp;de&nbsp;protecci\u00f3n, lo&nbsp;que&nbsp;podr\u00eda&nbsp;socavar&nbsp;el&nbsp;objetivo&nbsp;de&nbsp;armonizaci\u00f3n&nbsp;de la&nbsp;Directiva.&nbsp;<\/p>\n\n\n\n<p>5.&nbsp;Efecto&nbsp;disuasorio&nbsp;sobre&nbsp;la&nbsp;denuncia&nbsp;<\/p>\n\n\n\n<p>Los&nbsp;riesgos&nbsp;persistentes&nbsp;de&nbsp;represalias&nbsp;y la confianza&nbsp;insuficiente&nbsp;en&nbsp;las&nbsp;garant\u00edas&nbsp;institucionales&nbsp;contribuyen&nbsp;a un&nbsp;efecto&nbsp;disuasorio, lo&nbsp;que&nbsp;limita&nbsp;el&nbsp;uso&nbsp;pr\u00e1ctico&nbsp;de&nbsp;los&nbsp;mecanismos&nbsp;de&nbsp;denuncia.&nbsp;<\/p>\n\n\n\n<p><strong>El&nbsp;v\u00ednculo&nbsp;jur\u00eddico&nbsp;entre la&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes&nbsp;y la&nbsp;eficacia&nbsp;de la lucha contra la&nbsp;corrupci\u00f3n<\/strong>&nbsp;<\/p>\n\n\n\n<p>Desde&nbsp;un punto de vista&nbsp;jur\u00eddico, la&nbsp;protecci\u00f3n&nbsp;de&nbsp;los&nbsp;denunciantes&nbsp;funciona&nbsp;como&nbsp;un&nbsp;mecanismo&nbsp;de&nbsp;aplicaci\u00f3n&nbsp;de la ley&nbsp;que&nbsp;complementa&nbsp;los&nbsp;sistemas&nbsp;reguladores&nbsp;y de&nbsp;supervisi\u00f3n&nbsp;tradicionales.
