{"id":1155,"date":"2026-03-26T10:05:00","date_gmt":"2026-03-26T10:05:00","guid":{"rendered":"https:\/\/voiceguard-project.eu\/?p=1155"},"modified":"2026-05-04T13:31:30","modified_gmt":"2026-05-04T13:31:30","slug":"actualites-concernant-la-directive-sur-les-lanceurs-dalerte-et-tendances-en-matiere-dapplication-a-surveiller-en-2025-2026","status":"publish","type":"post","link":"https:\/\/voiceguard-project.eu\/fr\/2026\/03\/26\/actualites-concernant-la-directive-sur-les-lanceurs-dalerte-et-tendances-en-matiere-dapplication-a-surveiller-en-2025-2026\/","title":{"rendered":"Actualit\u00e9s\u00a0concernant\u00a0la directive sur les\u00a0lanceurs\u00a0d&rsquo;alerte\u00a0et tendances\u00a0en\u00a0mati\u00e8re\u00a0d&rsquo;application\u00a0\u00e0\u00a0surveiller\u00a0en\u00a02025-2026\u00a0"},"content":{"rendered":"\n<p>Avec&nbsp;l\u2019adoption&nbsp;de la directive (UE) 2019\/1937 (\u00ab directive sur la&nbsp;d\u00e9nonciation&nbsp;\u00bb) et sa transposition dans les&nbsp;l\u00e9gislations&nbsp;nationales&nbsp;des \u00c9tats&nbsp;membres&nbsp;(\u00ab EM \u00bb) de&nbsp;l\u2019Union&nbsp;europ\u00e9enne&nbsp;(\u00ab directive&nbsp;europ\u00e9enne&nbsp;sur la&nbsp;d\u00e9nonciation&nbsp;\u00bb),&nbsp;l\u2019UE&nbsp;a&nbsp;concr\u00e9tis\u00e9&nbsp;l\u2019harmonisation&nbsp;compl\u00e8te&nbsp;des protections&nbsp;minimales&nbsp;accord\u00e9es&nbsp;aux&nbsp;lanceurs&nbsp;d\u2019alerte.&nbsp;<\/p>\n\n\n\n<p>\u00c0&nbsp;l\u2019horizon&nbsp;2025 et au-del\u00e0,&nbsp;plusieurs&nbsp;extensions&nbsp;l\u00e9gislatives,&nbsp;\u00e9valuations&nbsp;et transpositions&nbsp;sont&nbsp;\u00e0&nbsp;venir, qui&nbsp;auront&nbsp;une&nbsp;incidence non&nbsp;seulement&nbsp;sur le&nbsp;champ&nbsp;d\u2019application&nbsp;mat\u00e9riel de la directive,&nbsp;mais&nbsp;aussi&nbsp;sur&nbsp;l\u2019\u00e9volution&nbsp;des&nbsp;meilleures&nbsp;pratiques&nbsp;en&nbsp;mati\u00e8re de protection des&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;en&nbsp;g\u00e9n\u00e9ral.&nbsp;<\/p>\n\n\n\n<p><strong>\u00c9valuation&nbsp;de la directive&nbsp;europ\u00e9enne&nbsp;sur les&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;de 2025 et extension&nbsp;\u00e9ventuelle&nbsp;de son&nbsp;champ&nbsp;d\u2019application<\/strong>&nbsp;<\/p>\n\n\n\n<p>D\u2019ici&nbsp;<strong>le 17&nbsp;d\u00e9cembre&nbsp;2025<\/strong>, la Commission doit&nbsp;pr\u00e9senter&nbsp;au Parlement&nbsp;europ\u00e9en&nbsp;et au Conseil un rapport&nbsp;\u00e9valuant&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l&rsquo;efficacit\u00e9\u00a0des\u00a0lois\u00a0adopt\u00e9es\u00a0par les \u00c9tats\u00a0membres\u00a0pour transposer la\u00a0directive ;\u00a0et\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l&rsquo;efficacit\u00e9\u00a0du cadre de protection des\u00a0lanceurs\u00a0d&rsquo;alerte\u00a0dans\u00a0l&rsquo;UE.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Plus&nbsp;pr\u00e9cis\u00e9ment,&nbsp;en&nbsp;vertu&nbsp;<strong>de&nbsp;l\u2019article&nbsp;27,&nbsp;paragraphe&nbsp;3, de la directive sur les&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;<\/strong>:&nbsp;<\/p>\n\n\n\n<p>[La Commission]&nbsp;pr\u00e9sente&nbsp;au Parlement&nbsp;europ\u00e9en&nbsp;et au Conseil, au plus tard le 17&nbsp;d\u00e9cembre&nbsp;2025, un rapport sur la mise&nbsp;en&nbsp;\u0153uvre&nbsp;et&nbsp;l\u2019application&nbsp;de la&nbsp;pr\u00e9sente&nbsp;directive. Ce rapport doit&nbsp;notamment&nbsp;:&nbsp;<\/p>\n\n\n\n<p>(a)&nbsp;\u00e9valuer&nbsp;l\u2019efficacit\u00e9&nbsp;des&nbsp;mesures&nbsp;prises&nbsp;par&nbsp;chaque&nbsp;\u00c9tat&nbsp;membre&nbsp;pour transposer la&nbsp;pr\u00e9sente&nbsp;directive et&nbsp;leur&nbsp;incidence sur le&nbsp;fonctionnement&nbsp;du cadre de protection des&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;\u00e9tabli&nbsp;conform\u00e9ment&nbsp;\u00e0 la&nbsp;pr\u00e9sente&nbsp;directive ;&nbsp;et&nbsp;<\/p>\n\n\n\n<p>(b)&nbsp;\u00e9valuer&nbsp;si&nbsp;des&nbsp;mesures&nbsp;suppl\u00e9mentaires,&nbsp;<strong>y&nbsp;compris&nbsp;l\u2019extension&nbsp;du&nbsp;champ&nbsp;d\u2019application&nbsp;de la&nbsp;pr\u00e9sente&nbsp;directive \u00e0&nbsp;d\u2019autres&nbsp;actes&nbsp;de&nbsp;l\u2019Union&nbsp;ou&nbsp;domaines&nbsp;d\u2019action,&nbsp;<\/strong>sont&nbsp;n\u00e9cessaires.&nbsp;<\/p>\n\n\n\n<p>Les&nbsp;domaines&nbsp;d\u2019extension&nbsp;potentiels&nbsp;mentionn\u00e9s&nbsp;par la Commission&nbsp;comprennent:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0s\u00e9curit\u00e9\u00a0et\u00a0la\u00a0sant\u00e9\u00a0au\u00a0travail\u00a0;\u00a0et\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les\u00a0conditions\u00a0de\u00a0travail.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Les&nbsp;f\u00e9d\u00e9rations&nbsp;d&rsquo;entreprises&nbsp;ont&nbsp;indiqu\u00e9&nbsp;qu&rsquo;elles&nbsp;feraient&nbsp;probablement&nbsp;pression pour&nbsp;que&nbsp;le&nbsp;champ&nbsp;d&rsquo;application&nbsp;de la protection soit&nbsp;modifi\u00e9&nbsp;lors&nbsp;de&nbsp;ce&nbsp;premier&nbsp;r\u00e9examen.&nbsp;L&rsquo;une&nbsp;des modifications&nbsp;sugg\u00e9r\u00e9es&nbsp;consisterait&nbsp;\u00e0&nbsp;<strong>porter&nbsp;le&nbsp;nombre&nbsp;minimum de&nbsp;salari\u00e9s&nbsp;requis&nbsp;pour la mise&nbsp;en&nbsp;place de&nbsp;canaux&nbsp;de&nbsp;signalement&nbsp;internes de 50 \u00e0 100&nbsp;salari\u00e9s&nbsp;ou&nbsp;plus.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Une&nbsp;telle&nbsp;modification&nbsp;viserait&nbsp;\u00e0&nbsp;r\u00e9duire&nbsp;la charge administrative&nbsp;pesant&nbsp;sur les PME.&nbsp;<\/p>\n\n\n\n<p><strong>2026 \u2013 Extension des protections&nbsp;accord\u00e9es&nbsp;aux&nbsp;lanceurs&nbsp;d&rsquo;alerte&nbsp;de&nbsp;l&rsquo;UE&nbsp;pour&nbsp;couvrir&nbsp;la&nbsp;loi&nbsp;europ\u00e9enne&nbsp;sur&nbsp;l&rsquo;IA<\/strong>&nbsp;<\/p>\n\n\n\n<p>\u00c0&nbsp;compter&nbsp;du<strong>&nbsp;2&nbsp;ao\u00fbt&nbsp;2026<\/strong>, la directive sur les&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;s\u2019appliquera&nbsp;au&nbsp;signalement&nbsp;des violations de la&nbsp;<strong>loi&nbsp;europ\u00e9enne&nbsp;sur&nbsp;l\u2019IA<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>Qu&rsquo;est-ce&nbsp;que&nbsp;cela&nbsp;signifie&nbsp;?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Si vous&nbsp;travaillez&nbsp;pour un&nbsp;fournisseur&nbsp;<strong>d\u2019IA&nbsp;\u00e0 usage&nbsp;g\u00e9n\u00e9ral&nbsp;(\u00ab GPAI \u00bb)<\/strong>, vous&nbsp;\u00eates&nbsp;prot\u00e9g\u00e9&nbsp;si&nbsp;vous&nbsp;signalez&nbsp;que&nbsp;le&nbsp;produit&nbsp;de&nbsp;ce&nbsp;fournisseur&nbsp;\u2013&nbsp;dont&nbsp;on vous a&nbsp;indiqu\u00e9&nbsp;qu\u2019il&nbsp;s\u2019agit&nbsp;<strong>d\u2019une&nbsp;\u00ab IA&nbsp;pr\u00e9sentant&nbsp;un&nbsp;risque&nbsp;syst\u00e9mique&nbsp;\u00bb au&nbsp;sens&nbsp;de&nbsp;l\u2019article&nbsp;2,&nbsp;paragraphe&nbsp;11, de la&nbsp;loi&nbsp;sur&nbsp;l\u2019IA&nbsp;<\/strong>\u2013 ne dispose pas de&nbsp;mesures&nbsp;de&nbsp;cybers\u00e9curit\u00e9&nbsp;ad\u00e9quates,&nbsp;en&nbsp;violation de&nbsp;<strong>l\u2019article&nbsp;55 de&nbsp;ladite&nbsp;loi<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Les&nbsp;exemples&nbsp;ci-dessus ne&nbsp;couvrent&nbsp;pas&nbsp;actuellement&nbsp;tous&nbsp;les&nbsp;risques&nbsp;li\u00e9s&nbsp;\u00e0&nbsp;l&rsquo;IA,&nbsp;mais&nbsp;cette&nbsp;modification&nbsp;<strong>\u00e9largira&nbsp;consid\u00e9rablement&nbsp;le&nbsp;champ&nbsp;d&rsquo;application&nbsp;des protections&nbsp;accord\u00e9es&nbsp;aux&nbsp;lanceurs&nbsp;d&rsquo;alerte,&nbsp;celles-ci&nbsp;s&rsquo;appliquant&nbsp;d\u00e9sormais&nbsp;\u00e0 de&nbsp;nombreux&nbsp;types de&nbsp;risques&nbsp;li\u00e9s&nbsp;\u00e0&nbsp;l&rsquo;IA.<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>2026 et au-del\u00e0&nbsp;\u2013&nbsp;\u00c9largissement&nbsp;du&nbsp;champ&nbsp;d\u2019application&nbsp;via la CSDDD<\/strong>&nbsp;<\/p>\n\n\n\n<p>Le&nbsp;champ&nbsp;d\u2019application&nbsp;de la directive sur la&nbsp;d\u00e9nonciation&nbsp;sera&nbsp;\u00e9galement&nbsp;\u00e9largi&nbsp;par la&nbsp;<strong>directive sur la diligence&nbsp;raisonnable&nbsp;en&nbsp;mati\u00e8re de&nbsp;durabilit\u00e9&nbsp;des&nbsp;entreprises&nbsp;(CSDDD)<\/strong>, qui est entr\u00e9e&nbsp;en&nbsp;vigueur&nbsp;le<strong>&nbsp;25&nbsp;juillet&nbsp;2024<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Cette directive&nbsp;modifie&nbsp;la directive sur la&nbsp;d\u00e9nonciation&nbsp;de mani\u00e8re \u00e0&nbsp;ce&nbsp;que&nbsp;des protections&nbsp;soient&nbsp;\u00e9galement&nbsp;accord\u00e9es&nbsp;aux&nbsp;personnes&nbsp;signalant&nbsp;des violations de la&nbsp;l\u00e9gislation&nbsp;nationale&nbsp;qui met&nbsp;en&nbsp;\u0153uvre&nbsp;les exigences de&nbsp;l\u2019UE&nbsp;en&nbsp;mati\u00e8re&nbsp;de&nbsp;diligence&nbsp;raisonnable&nbsp;en&nbsp;mati\u00e8re de&nbsp;durabilit\u00e9.&nbsp;<\/p>\n\n\n\n<p>En&nbsp;d&rsquo;autres&nbsp;termes, les&nbsp;lanceurs&nbsp;d&rsquo;alerte&nbsp;signalant&nbsp;des violations de la&nbsp;l\u00e9gislation&nbsp;nationale&nbsp;relatives&nbsp;\u00e0 :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les\u00a0droits\u00a0du\u00a0travail\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la\u00a0diligence\u00a0raisonnable\u00a0en\u00a0mati\u00e8re\u00a0de\u00a0droits\u00a0de\u00a0l&rsquo;homme\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les\u00a0dommages\u00a0environnementaux\u00a0<\/li>\n<\/ul>\n\n\n\n<p>pourront&nbsp;b\u00e9n\u00e9ficier&nbsp;des&nbsp;<strong>protections&nbsp;pr\u00e9vues&nbsp;par la directive&nbsp;europ\u00e9enne&nbsp;sur les&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;<\/strong>d\u00e8s&nbsp;que&nbsp;la directive CSDDD aura&nbsp;\u00e9t\u00e9&nbsp;transpos\u00e9e&nbsp;en&nbsp;droit national par les \u00c9tats&nbsp;membres.&nbsp;<\/p>\n\n\n\n<p>Dans&nbsp;l&rsquo;ensemble, les&nbsp;employ\u00e9s&nbsp;peuvent&nbsp;b\u00e9n\u00e9ficier&nbsp;d&rsquo;une&nbsp;protection&nbsp;lorsqu&rsquo;ils&nbsp;signalent&nbsp;des&nbsp;activit\u00e9s&nbsp;qui portent&nbsp;atteinte&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l&rsquo;environnement\u00a0;\u00a0ou\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les\u00a0normes\u00a0du travail\u00a0reconnues,\u00a0telles\u00a0que\u00a0celles\u00a0\u00e9nonc\u00e9es\u00a0dans\u00a0<strong>les conventions de\u00a0l\u2019Organisation\u00a0internationale\u00a0du travail\u00a0(\u00ab OIT \u00bb)<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>L&rsquo;UE se&nbsp;concentre&nbsp;sur&nbsp;l&rsquo;am\u00e9lioration&nbsp;de la mise&nbsp;en&nbsp;\u0153uvre&nbsp;de la directive sur les&nbsp;lanceurs&nbsp;d&rsquo;alerte<\/strong>&nbsp;<\/p>\n\n\n\n<p>Outre&nbsp;l\u2019\u00e9valuation&nbsp;d\u2019\u00e9ventuelles&nbsp;extensions du&nbsp;champ&nbsp;d\u2019application&nbsp;de la directive&nbsp;europ\u00e9enne&nbsp;sur les&nbsp;lanceurs&nbsp;d\u2019alerte,&nbsp;l\u2019UE&nbsp;examinera&nbsp;de plus&nbsp;en&nbsp;plus&nbsp;attentivement&nbsp;les mises&nbsp;en&nbsp;\u0153uvre&nbsp;existantes&nbsp;par les \u00c9tats&nbsp;membres.&nbsp;<\/p>\n\n\n\n<p>En&nbsp;<strong>juillet&nbsp;2024<\/strong>, la Commission a&nbsp;publi\u00e9&nbsp;un rapport sur la mise&nbsp;en&nbsp;\u0153uvre&nbsp;et la transposition de la directive. Ce rapport a mis&nbsp;en&nbsp;\u00e9vidence&nbsp;plusieurs&nbsp;lacunes,&nbsp;notamment&nbsp;:&nbsp;<\/p>\n\n\n\n<p><strong>Probl\u00e8me&nbsp;n\u00b0&nbsp;1 :&nbsp;Champ&nbsp;d\u2019application&nbsp;de la protection<\/strong>&nbsp;<\/p>\n\n\n\n<p>Absence de protection&nbsp;ad\u00e9quate&nbsp;des&nbsp;signalements&nbsp;effectu\u00e9s&nbsp;sur la base de soup\u00e7ons&nbsp;raisonnables&nbsp;ou&nbsp;des&nbsp;tentatives&nbsp;de dissimulation&nbsp;d\u2019infractions.&nbsp;<\/p>\n\n\n\n<p><strong>Probl\u00e9matique&nbsp;n\u00b0&nbsp;2 :&nbsp;sanctions<\/strong>&nbsp;<\/p>\n\n\n\n<p>Neuf \u00c9tats&nbsp;membres&nbsp;n\u2019ont&nbsp;pas&nbsp;clairement&nbsp;pr\u00e9vu&nbsp;que&nbsp;des sanctions&nbsp;s\u2019appliquent&nbsp;en&nbsp;cas&nbsp;de&nbsp;repr\u00e9sailles&nbsp;\u00e0&nbsp;l\u2019encontre&nbsp;des&nbsp;lanceurs&nbsp;d\u2019alerte,&nbsp;d\u2019entrave&nbsp;aux&nbsp;canaux&nbsp;de&nbsp;signalement&nbsp;ou&nbsp;de non-respect de la&nbsp;confidentialit\u00e9&nbsp;de&nbsp;l\u2019identit\u00e9&nbsp;des&nbsp;lanceurs&nbsp;d\u2019alerte.&nbsp;<\/p>\n\n\n\n<p><strong>Question n\u00b0&nbsp;3 :&nbsp;Exon\u00e9rations&nbsp;de&nbsp;responsabilit\u00e9<\/strong>&nbsp;<\/p>\n\n\n\n<p>Certains&nbsp;\u00c9tats&nbsp;membres&nbsp;n\u2019ont&nbsp;pas&nbsp;transpos\u00e9&nbsp;de mani\u00e8re&nbsp;ad\u00e9quate&nbsp;les dispositions de la directive&nbsp;pr\u00e9cisant&nbsp;dans&nbsp;quels&nbsp;cas&nbsp;les&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;ne&nbsp;peuvent&nbsp;\u00eatre&nbsp;tenus&nbsp;pour&nbsp;responsables&nbsp;de la divulgation&nbsp;d\u2019informations&nbsp;si&nbsp;celle-ci a&nbsp;\u00e9t\u00e9&nbsp;effectu\u00e9e&nbsp;dans le but de&nbsp;r\u00e9v\u00e9ler&nbsp;une&nbsp;infraction.&nbsp;<\/p>\n\n\n\n<p>La Commission a&nbsp;d\u00e9clar\u00e9&nbsp;que&nbsp;ces&nbsp;points&nbsp;constituaient&nbsp;les&nbsp;<strong>\u00ab&nbsp;principales&nbsp;lacunes \u00bb&nbsp;<\/strong>dans la mise&nbsp;en&nbsp;\u0153uvre&nbsp;de la directive.&nbsp;<\/p>\n\n\n\n<p>Peu apr\u00e8s,&nbsp;<strong>d\u00e9but 2025<\/strong>, la Commission a mis \u00e0&nbsp;ex\u00e9cution&nbsp;ses&nbsp;menaces de&nbsp;renforcer&nbsp;les&nbsp;mesures&nbsp;coercitives&nbsp;en&nbsp;infligeant&nbsp;aux \u00c9tats&nbsp;membres&nbsp;une&nbsp;amende&nbsp;collective&nbsp;<strong>de&nbsp;38&nbsp;millions&nbsp;d\u2019euros&nbsp;<\/strong>pour ne pas&nbsp;avoir&nbsp;respect\u00e9&nbsp;la&nbsp;<strong>date&nbsp;limite&nbsp;du 17&nbsp;juillet&nbsp;2024&nbsp;<\/strong>fix\u00e9e&nbsp;pour la transposition de la directive.&nbsp;<\/p>\n\n\n\n<p>Nous&nbsp;nous&nbsp;attendons&nbsp;\u00e0&nbsp;ce&nbsp;que&nbsp;cette&nbsp;tendance se&nbsp;poursuive, la Commission&nbsp;\u00e9tendant&nbsp;d\u00e9sormais&nbsp;son&nbsp;contr\u00f4le&nbsp;au-del\u00e0&nbsp;du non-respect des&nbsp;d\u00e9lais&nbsp;de transposition&nbsp;pour&nbsp;s\u2019int\u00e9resser&nbsp;\u00e0 la&nbsp;<strong>qualit\u00e9&nbsp;de la mise&nbsp;en&nbsp;\u0153uvre&nbsp;par les \u00c9tats&nbsp;membres<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>\u00c9volution&nbsp;vers la&nbsp;pr\u00e9vention&nbsp;dans les&nbsp;normes&nbsp;de protection des&nbsp;lanceurs&nbsp;d\u2019alerte<\/strong>&nbsp;<\/p>\n\n\n\n<p>Au-del\u00e0&nbsp;de&nbsp;l\u2019\u00e9largissement&nbsp;du&nbsp;champ&nbsp;d\u2019application&nbsp;mat\u00e9riel de la directive&nbsp;europ\u00e9enne&nbsp;sur les&nbsp;lanceurs&nbsp;d\u2019alerte, les&nbsp;normes&nbsp;de protection des&nbsp;lanceurs&nbsp;d\u2019alerte&nbsp;en&nbsp;Europe&nbsp;\u00e9voluent.&nbsp;<\/p>\n\n\n\n<p>Traditionnellement, les&nbsp;lanceurs&nbsp;d&rsquo;alerte&nbsp;\u00e9taient&nbsp;prot\u00e9g\u00e9s&nbsp;<strong>a posteriori&nbsp;<\/strong>par&nbsp;le&nbsp;biais&nbsp;de&nbsp;poursuites&nbsp;judiciaires&nbsp;visant&nbsp;\u00e0&nbsp;obtenir&nbsp;des&nbsp;dommages-int\u00e9r\u00eats&nbsp;de la part
